Terms of Service

01Acceptance of these Terms

You are contracting with AIROVA AI CONSULTANT CO., LTD., a company registered in Thailand under registration number 0105569058191.

By accessing our website, creating an account, purchasing a plan, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not accept them, please stop using the services.

If you use the services on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

02Services covered

These Terms cover the following services:

• The airova.ai website, including articles, the readiness assessment, and the AI Consultant chat.
• AiROVA Consulting — AI advisory and implementation services.
• ROVA OS — our business operating system.
• AiLearning — courses and community.
• AiROVA Studio — our AI content-creation platform (text, image, video).

For Consulting and implementation work, the scope, price, and project-specific terms are set out in a separate quotation or contract, which prevails over these Terms in the event of conflict.

Several sections below (credits, payment, rights in output, file retention) apply primarily to AiROVA Studio.

03Who may use the services

• You must be at least 20 years old.
• Our services are designed for business and professional use.
• You must provide accurate information when registering and keep it up to date.
• If we find that a user is under the minimum age, we will suspend the account and delete the associated data.

04Your account

• You are responsible for keeping your password and login details secure. All activity under your account is your responsibility.
• If you suspect unauthorised access, notify us immediately at [email protected].
• AiROVA Studio is team-based (workspaces). People you invite to a team can access that team's work and credits according to the permissions you grant. The team owner is responsible for managing members.
• For security, accounts are temporarily locked after repeated failed login attempts.

05Plans and credits

AiROVA Studio uses credits to run AI generations. Each image or video generation deducts credits at the rate shown in the app at that time.

• Subscription credits refresh each billing cycle and do not roll over — any unused balance expires when the new cycle begins.
• Top-up credits are valid for 6 months (180 days) from the date of purchase.
• The new-signup bonus is 30 credits, once per user, valid for 14 days.
• Referral credits are valid for 365 days.
• The system always consumes the credits closest to expiry first.
• The credit cost per generation may change in line with our AI providers' costs. We display the current rate in the app before you start a generation.

Credits are not currency. They cannot be transferred, resold, or exchanged for cash.

06Payment

• We use Stripe as our payment processor. AiROVA does not store your card number on our systems.
• Monthly and annual plans renew automatically until you cancel. You can cancel renewal yourself at any time from the billing portal in the app, and will retain access until the end of the period you have already paid for.
• Prices shown on the website are launch pricing. We reserve the right to change prices in future; a price change will not affect a billing period you have already paid for.
• If a payment fails, we may suspend access to paid features until payment succeeds.

07Refunds

Purchased credits and paid fees are non-refundable. Every generation you run incurs an immediate, non-recoverable cost that we pay to our AI providers.

We will consider refunding credits or money in these cases:

• A fault on our side deducted credits but produced no output — we will restore the credits.
• A duplicate or erroneous charge.
• Any case where Thai consumer protection law requires a refund.

If you believe one of the above applies, contact us at [email protected] within 7 days of the transaction with the transaction details.

Where a payment is refunded through Stripe, the credits granted by that transaction will be reclaimed from your account.

08Content you upload

The files, images, text, and prompts you upload or type into the system remain yours. AiROVA claims no ownership of them.

To deliver the service, you grant us permission to store, process, and transmit that content to the AI providers required (see section 12), solely to the extent needed to produce your output. This permission ends when the content is deleted from our systems.

You confirm that you hold the rights to the content you upload, and that uploading it does not infringe anyone else's copyright, trademark, or likeness rights.

We do not use your content, prompts, or output to train our own AI models.

09Output generated for you

• Output (images, video, text) generated from your account belongs to you, and you may use it commercially.
• AI is probabilistic. Other users entering similar prompts may receive similar output, so we cannot guarantee that your output is unique, nor that it will qualify for copyright registration.
• AI can produce inaccurate or misleading content. You should review output before publishing it or relying on it for business decisions.
• You are responsible for how you use the output, including checking that it does not infringe the rights of others and complies with applicable law, such as advertising rules.

10Publishing your work as a public template

AiROVA Studio lets you choose to publish work you have already generated as a public template in the Template Marketplace.

Before you publish, note that:

• Publishing is entirely your own choice. We never publish your work automatically.
• Once our team approves it, that item's sample output and prompt become publicly visible to other users, who may use it as a starting point.
• Do not publish work containing confidential information, customer data, or intellectual property you do not want others to see.
• You may request removal of a published template by contacting [email protected], but copies already used by other users may persist.
• We reserve the right to reject or remove templates we consider inappropriate.

11Prohibited use

You may not use our services to:

• Create content that depicts minors inappropriately.
• Create images or video of real people — public figures in particular — in order to deceive, impersonate, or mislead.
• Upload copyrighted images or works belonging to others without the right to use them.
• Create unlawful content, pornography, violent content, or hate speech.
• Deceive, defraud, spam, or fabricate reviews or evidence.
• Attempt to breach, reverse engineer, or scrape our systems, or place unreasonable load on them to the detriment of other users.
• Resell or provide onward access to our systems to third parties without our written permission.

Our AI providers automatically detect and refuse certain categories of request — for example, prompts involving minors, public figures, or copyrighted source images.

12Third-party providers

To deliver the service, we transmit some data to third-party providers:

• AI model providers — Google (Gemini, Veo, Imagen), OpenAI, and Anthropic receive your prompts and reference files in order to generate output.
• Stripe — payment processing.
• Cloudflare — file storage and delivery.
• Google Cloud — the servers that run our systems.
• Sentry — error logging.

These providers process data under their own terms and policies, which we do not fully control. If a provider discontinues its service or changes its terms, we may need to change the models or features we offer.

Details of what data goes where, how long it is kept, and whether it leaves Thailand are set out in our Privacy Policy.

13File storage and deletion

Files you upload and output you generate in AiROVA Studio are deleted automatically once the retention period for your plan expires, as set out in the table below.

• After expiry, files move to trash and remain recoverable for a further 7 days before permanent deletion.
• Files saved to your Asset Library or Brand Kit are exempt from this schedule, subject to the slot limit for your plan.
• If you cancel or downgrade your plan, the retention period changes to that of the new plan.
• If you ask us to close your account (email [email protected]), we delete your files and data as described in our Privacy Policy.

14Service availability

• AiROVA Studio is in beta. Features may change, be added, or be withdrawn.
• The services are provided on an as-is basis. We do not guarantee uninterrupted availability.
• We may take the system down for maintenance when necessary, and will give notice where we can.
• The quality and availability of output depend on third-party AI models, which may change outside our control.

15Suspension and termination

We may suspend or terminate your account if:

• You breach section 11 (Prohibited use).
• There is payment fraud, or a chargeback raised without merit.
• Your use creates legal or security risk for us or for other users.

In serious cases we may suspend immediately without prior notice. Otherwise, we will notify you and give you an opportunity to put things right.

You can cancel plan renewal yourself at any time from the billing portal in the app.

To close your account permanently and have your data deleted, email [email protected] — we act within 30 days (see 'How to exercise your rights / request deletion' in our Privacy Policy for the full process).

On closure, any remaining credits lapse and are not refundable in cash.

16AiROVA's intellectual property

Our software and systems, the names AiROVA / ROVA OS / AiROVA Studio, our logos, website content, documentation, and the templates our team creates are the intellectual property of AiROVA or our licensors.

These Terms grant you only the right to access the services under the plan you have subscribed to. They do not transfer ownership of our software or brand to you.

You may not copy, modify, decompile, or reproduce our software, except where the law permits.

17Privacy

How we collect and use your personal data is governed by our Privacy Policy, which forms part of these Terms. It explains what we collect, who we share it with, whether it leaves Thailand, and what rights you have under the PDPA.

18Limitation of liability

To the extent permitted by law:

• AiROVA is not liable for indirect or consequential loss, lost profits, lost business opportunity, or loss of data.
• Our total liability for any claim will not exceed the amount you actually paid us in the 6 months before the event giving rise to the claim.
• We are not liable for the consequences of how you use AI output, including any allegation that the output infringes someone else's rights.
• We are not liable for force majeure or events beyond our control, such as an AI provider or infrastructure provider going offline.

Nothing above removes rights you have as a consumer under Thai law, and these limits do not apply to our wilful misconduct or gross negligence.

19Changes to these Terms

We may update these Terms as our services or legal requirements change. The 'Last updated' date at the top reflects the latest revision.

For material changes — for example to pricing, refunds, or rights in output — we will give at least 30 days' notice by email or in-app. If you do not agree, you may close your account before the change takes effect.

Continuing to use the services after the effective date means you accept the revised Terms.

20Governing law

These Terms are governed by the laws of Thailand.

If a dispute arises, please contact us first at [email protected] so we can try to resolve it together. If we cannot, the Thai courts will have jurisdiction.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
